Terms of Service

1. General provisions

These Terms set out the rules under which The Nest (NEST EQUINOX CAPITAL PARTNERS) provides virtual office and office space rental services.

Using The Nest's services constitutes acceptance of these Terms.

2. Definitions

Service Provider

NEST EQUINOX CAPITAL PARTNERS, with its registered seat in Warsaw.

Client

a natural person, legal person or organisational unit using the services.

Virtual office

a service comprising a prestigious address, mail collection and other services without physical office space.

Office space

physical office space rented to the Client.

3. Scope of services

The Nest provides the following services:

• Virtual office (Standard, Business and VIP packages)
• Office space rental on a subscription basis
• An address for company registration
• Receipt and handling of mail
• Reception services
• Access to meeting rooms (depending on the package)

4. Conclusion of the contract

The contract is concluded upon:

• signing a written agreement, or
• accepting an online offer and making the first payment

The contract is concluded for a fixed or indefinite term, in accordance with the package selected.

5. Payments

Fees for the services are paid:

• in advance, for the given billing period (month)
• by bank transfer or another form accepted by the Service Provider
• by the date specified on the invoice

Failure to pay on time may result in suspension of the services or termination of the contract.

6. Client obligations

• Paying fees on time
• Using the services in accordance with their intended purpose
• Observing the building's rules of order
• Notifying us without delay of changes to contact details
• Collecting mail regularly (for the virtual office)

7. Termination

The contract may be terminated:

• by agreement of the parties at any time
• by either party with 30 days of notice
• with immediate effect in the event of a gross breach of its provisions

8. Liability

The Service Provider is not liable for damage resulting from improper use of the services by the Client, nor for items left unattended in the office space.

9. Free online tools

The Service Provider makes free online tools available on the Website.

• The tools are free of charge, require no registration or contract, and are not a service within the meaning of point 3 of these Terms.
• The tools run in the User's browser. Answers entered in a tool are not sent to the Service Provider, are not stored by it, and disappear when the tab is refreshed or closed. PDF and calendar files are created on the User's device.
• The tools are informational. They are not legal, tax or immigration advice and are not a company registration service — the User files applications with the registers themselves. The Service Provider does not register companies and does not represent the User before public authorities.
• The information in the tools describes the law as at the date shown in the tool and may change. The Service Provider keeps the content consistent with the sources cited, but does not guarantee that it is complete or current; the User makes decisions based on it at their own risk.
• Using the tools requires a web browser with JavaScript enabled.
• The User must not supply unlawful content.
• The Service Provider may change the scope of the tools or withdraw them at any time.

Complaints about the tools can be sent to the Service Provider's e-mail address given in point 11. A complaint should identify the tool and describe the issue. A reply will be sent to the address the complaint came from within 14 days.

10. Final provisions

Matters not governed by these Terms are subject to the provisions of the Polish Civil Code and other applicable provisions of Polish law.

Any disputes shall be settled by the court having jurisdiction over the Service Provider's registered seat.
